    Default Disruption of School Charges Against a Minor

    A student in a South Carolina school went to another student's desk to speak to her, and when he put his hand on her desk he accidentally discharged a canister of mace that she kept on her keychain. He was suspended for three days, but she was not punished at all. Now he is charged with disruption of school. Can he be charged with disrupting the school for an accident?

    Yes he can, and it will be an unusual mace canister that can be easily discharged by accident. He should get a lawyer and explain his version of events to his lawyer. The lawyer can review the version in the police report, and statements from the other students, to see if it may be possible to convince the prosecutor or court that this was in fact an accident.
