    Default Can a Parent Sponsor a F1 Student for a Green Card

    An F1 student who has an expired visa, but a valid I-20, is in the U.S., and her mother wants to sponsor her for permanent residency. The mother will become a legal permanent resident in approximately three months, as a result of marriage to a U.S. Citizen. After she's a LPR, can the mother sponsor her daughter?

    If the mother was married to her U.S. Citizen spouse before the child reached the age of 18, her husband may file for permanent residency for both the mother and her child.

    If not, the mother can petition for her daughter's permanent residency once she, herself, is a LPR, but the daughter will have to maintain valid status (that is, a valid I-20). If taking this approach, it's sensible to work with an immigration lawyer.
