    Default Is the U.S. Trustee a Fiduciary to a Bankruptcy Proceeding

    In a bankruptcy case is the U.S. Trustee, as distinguished from the panel trustee who is assigned to a specific case, a fiduciary of the debtor and bankrupt estate?

    The U.S. Trustee appoints the panel trustee. Neither the U.S. Trustee nor the panel trustee have a duty to the debtor -- their duty is to the creditors of the bankrupt estate.
