    Default Mother-in-law / Guardianship / Divorce

    How do I get a divorce when my mother-in-law is the guardian of my son? How does that work? Do we have to get him back first? What happens to my son as far as custody? Do I have to take her and my husband to court for custody?

    To divorce your husband, you file for divorce against your husband. It has nothing to do with the guardianship.

    If the guardianship is through the courts, your divorce won't end the guardianship - you would have to fulfill whatever conditions the court set to end the guardianship. Laws are different for each state.
