    Default What constitutes 'Written Notice"?

    Chicago, IL

    I am having a dispute with my landlord. I rented a storage space in May and signed a month to month lease. He has notified me that he wants me out of the space by March 1st. He says he mailed notification of intent to terminate. He mailed it to my old address and I never received it. I suppose he has the returned mail to provide the evidence of the timely mailing.

    Question: Does this constitute 'Written Notice'?

    Did you ever update your address with the landlord before he sent the notice?

    No. I mailed him checks and the envelopes had my new address but I never formally provided notice of an address change.

    Kinda of a grey area but he may have met his obligation. Was your mail not forwarded?

    Nope, my mail wasn't forwarded.

    I'm thinking that I may as well accept that this was proper notice.

    so now the question is whether they can remove my goods prior to the date set forth in the notice.

    I think they'd have to go thru formal eviction process and that would take time.

    If the rental is only of a storage unit it's not a residential eviction, so rules will be different than for residential evictions. If the notice was sent to the address you had on file with your landlord, that's almost certainly an acceptable address for service of a notice terminating your tenancy in the storage unit.

    If the notice says you're being terminated as of March 1, what makes you think they would move your belongings out before that date?
