    Default Are Debts Owed to Former Landlords Discharged in Bankruptcy

    If you are evicted from an apartment, and there is a claim for damages that you supposedly caused, claims for damages and rent due dischargeable in bankruptcy?

    Although a claim for intentionally caused damage might survive bankruptcy, claims for back rent, rent owed due to a broken lease, or damages caused by negligence are normally dischargeable in bankruptcy. In a Chapter 13 bankruptcy, some portion of the debt may be repayable as part of the Chapter 13 plan.
