    Default Rights to a Home Purchased Before Marriage, but With Marital Contribution to Payments

    My question involves a marriage in the state of: Texas
    My husband bought a house for us when we were dating in his name. We both moved in on the same day September of 2012 with my two kids that are not his. We didn't get married until July of 2014. From the first day we moved in together I have contributed to the house payments. Everything we have from my car to credit cards is all in his name because he has good credit and I didn't. Now he is wanting a divorce and is telling me to find somewhere else to live with two kids. What's the chances of me and my kids getting to stay in the house?

    Not very good. You would be entitled to half the marital equity but the house is his premarital property.

    However, you do not have to leave until the court says you have to leave. He cannot kick you out of the marital home.

    Texas has very strong protection of separate property, as compared to many other states. Where a spouse contributes to the mortgage, taxes, upkeep, and the like that should not change the characterization of the property, but depending upon the type of contributions made a divorce court may allow the spouse to recover reimbursements for contributions that enhance the value of the separately owned real estate.
