    Default At What Age Can You Move Out With Your Parents' Consent

    My question involves juvenile law in the state of Michigan :
    So I'm 15, turning 16 in November right so my mom has some problems and I can't really go live with her and don't want to, and my dad is abusive and I'm living with my sister and her husband who are my guardians at the moment and I really don't want to move back with my mom or dad, and you can move out at 16 with your parents consent right?
    So say come November, I turn 16 and my sister still has guardianship of me, does that mean that they decide or does it mean my mother and father decide
    Also if my sister gets custody over me then is it their say on whether or not I can then?
    Another thing, if I do move out can someone else live in the house with me?
    One more thing, say both my parents agree that I can move out, will they still have to pay my sister child support?

    If a court granted your sister and brother-in-law guardianship over you, then it is your guardians who will have final say over where you live until such time as the court order is modified or terminated or you turn 18. If your sister and brother-in-law simply have been given guardianship by consent of your parents, then your parents can revoke that at any time and then they will determine where you live. If both your parents say its ok for you to live with your sister and she’s already your guardian then it seems like everyone is in agreement on where you’ll live so I don’t see where you’d have any concern about this. Your parents will have to pay child support to your sister only if your sister goes to court and gets an order requiring them to pay child support.

    If your sister has guardianship of you she decides where you live. If your sister somehow got custody of you then yes, she would control where you live until you're 18.

    Why are you so hell bent on moving out at 16? Do you have a job? Have you figured out how much it would cost to rent an apartment, transportation, utilities, and other such bills? What's wrong with living with your sister?

    If you leave without the consent of your guardian they can send the police after you and whoever is helping you can get in trouble too.

    I have a job and yes i know how much it would cost and it would work even when im in school. And the guardianship was only temporary for a year or whatever and as taxing said my dad can get me back at anytime really and I have to go back sometime and he's been abusive ever since I know and he's gonna hit me again and I'll just go back to my sister's and cause more stress
    I really just want to distance myself from my family and focus on myself instead of trying to help my mother financially or worry constantly about my dad going off and think this would be the best option

    I am confused... do you still want to live with your sister? Or are you trying to distance yourself from your family completely?

    You aren't going to get emancipated. For a couple of reasons. One, you aren't already supporting yourself. Two, emancipation is not a means to leave a bad situation. If you go back to your dad's, and he abuses you, then you call CPS. They will handle it.

    I feel bad for the stress you have about this, but emancipation isn't going to be your answer.

    "A year or whatever..." you don't even know? If you're being abused you need to tell someone. Counselor or teacher at school or call CPS yourself. Because until then you can't just do what you want. If you runaway you'll get reported as a runaway and the police will just take you back to whoever has custody or guardianship of you.

    And Taxing didn't say you'll go back to your dad. She said you would IF your parents had given consent to live there at your sister's. If the court awarded your sister guardianship than you stay with her until the court says otherwise.

    Basically where I'm at now the reason I'm at my sister's is because I was doing bad in school because I was really depressed and suicidal so what happened is they made me go with my sister because my dad was abusive I went to the psych ward because I was suicidal and my counselor basically said since I was failing 1 class that I want doing better here than I was at my dad's I really don't like him but at the same time if I quit, counsling my dad will just take me back by revoking the guardianship and when I get back to the house so be abusive and I'll just have to go to the court all over again make people pay more fines and cause my sister more stress

    If you have mental health issues you really stand no chance of being emancipated.

    You state that your dad will take you back if you quit counceling. Why dont you just keep going?

If so, your father can seek to terminate the guardianship or even leave a form of guardianship in place but seek physical custody but, again, if this situation was court ordered, your father doesn't make the decisions.

    Legal emancipation is not going to happen, honey. It's just not.

    While it is true that you can move out with consent, that consent can be revoked any time. I think your best bet is really going to be to keep going to counseling so that you can stay at your sister's.
