    Default Immigration for a Former Permanent Residence Who Lost His Status

    A man was married in the U.S. and became a U.S. legal permanent resident, but he separated from his wife and returned to his nation of origin. They later divorced. Years later, long after he's lost permanent resident status, he has met a U.S. citizen who lives in his home country. They want to get married and return to the United States. Will the prior permanent residency and divorce affect his eligibility to immigrate as a spouse?

    The mere fact that he previously held and abandoned permanent residency won't affect a new application. As long as the marriage is lawful, he can seek marriage-based immigration.
