    Default How to Create an Enforceable Surrogacy Contract

    The intended parents of a child have identified a gestational surrogate, and they want to enter into a legal contract with the surrogate. In Minnesota, is it necessary that the contract be drafted by a lawyer, notarized, or meet other legal standards?

    There is no statute in Minnesota that directly addresses these issues. It would be an extremely good idea for the prospective parents to find a family lawyer who is experienced with surrogacy cases, and make sure that they enter into an agreement that is likely to protect their rights in the event of later problems or disagreements.
