What is the difference between the crime of burglary and the crime of aggravated burglary, in Tennessee?
Under Tennessee law, you commit burglary by entering into a structure without the permission of the owner with the intent of committing a crime (e.g., theft) while inside the structure.
The offense becomes aggravated burglary when the structure is a habitation, a place where people live.
If you break into a detached shed or garage to steal tools, that's burglary. If you break into a house, apartment, occupied camper, or even a tent in a campground, that is aggravated burglary.
