    Default Is a Police Agency Liable for Business Expenses You Incur Due to an Arrest

    My question involves police conduct in the State of: Iowa

    Is it a civil rights violation to deprive an individual from filing a motion in US Patent court to preserve a patent filing (costing $3500 to date) from abandonment?
    I was in phone contact with my patent agent that Tuesday, and failure to file a $400 motion before the next day (Friday) changed the venue to a motion to revive, costing well over $10,000.
    Police presented in my back yard that evening and I informed them they are interfering with my at-home business (stock trading and pursuing my patent.)
    The criminal matter was a claim of privacy violation, but was not considered an emergency because the complainer had a gun license and refused to mark his property in any way. The sheriff ignored my sole statements of (above) and my demand to quit trespassing on my property, and took me to jail.

    If the officer had probable cause to make the arrest and take you to jail, then what he did was lawful and your patent problems are not the officer’s concerns. It doesn’t have to be an “emergency” for the officer to arrest you on the spot if he has that probable cause. If the officer lacked probable cause then you might have something to pursue in a false arrest claim against the police department.

    But even if you have a case for false arrest, you have the problem that you could have avoided this kind of problem had you not waited until the last minute to do the filing. Surely you knew or should have known the filing was coming up for awhile. Whenever you wait until the last minute to do something you run the risk that some unforseen event will delay you and you won’t get it done on time. As a result, you might have a problem making a case for damages relating to the increased patent filing cost you incurred since part of the reason you lost out was your own procrastination.
