I called "ICE" at 1-866-347-2424, to ask some questions, they were the ones who ask my if I wanted to withdrawal my pettition, I said I didnt know I could, they said "yes" to tell them now, and they would give me a case number,, then send it it writing to my nearest INS office.

So ICE (which can't process any withdrawal request) sent you off to a different office. Let us know if you actually find somebody who will let you withdraw the petition, rather than somebody who refers you to another office. (Did they really refer to the USCIS as the INS?)

As has been repeatedly explained to you, there is no mechanism for withdrawing your petition.

If you actually find out that there is an informal procedure that the USCIS will allow you to follow, please share the details.

Until that happens, though, all we know is that an ICE agent believes it may be possible. And it's not an ICE agent's decision to make or authorize.

I went to the USCIS office to talk to an Immigration lawyer earlier and they told me that I can ask The National Visa Center to stop the process. They said I can call 603-334-0700 and tell them the case number and to "revoke" the petition. They also told me that you can send a letter with the Beneficiary's name and case number to NVC and you have to get it notarized also.

I think Mr. Knowitall is right that ICE is just an agent and they are not authorized to revoke/withdraw anything.

Thought maybe I can share this to anyone that has the same dillema as me.

That's helpful information. It would make more sense to me in the context of abandoning a visa application (such as a fiancée visa) as opposed to an I-130 petition for adjustment of status, as the I-130 is filed with the USCIS. (Why does the USCIS need to send you over to the State Department in order to suspend action on a form that falls under its own purview?) But if it works, it works. Let us know.

They sent me to the NVC so I can inform them to stop the process right away. Then the NVC will inform the USCIS office where the Petition was originally submitted and they will conduct an investigation. It's along process but we are willing to wait. I will let you know if this will owrk and hopefully it does. Thanks for your help and the people who posted their advise in my problem.

    Unhappy Im Back!

Sadly I have been in a roller coaster of where I can stop the the petition for my ex wife but they just tell me to go to NVC and then NVC told me to go USCIS where I originally filed the petition. I really want to withdraw this petition soon. Just wanted to let everybody know what Im going through with this. Thanks!

They really should implement a formal mechanism to withdraw petitions, or even to petition to withdraw a petition, such that this is no longer a source of so much confusion.

Thats true so people can also have just one answer instead of going through a lot of things and in the end they just bounce you like a ball on where to go.
