    A driver in New York was rear-ended at a red light. Two days later he was still in a lot of pain, so he went to the emergency room for evaluation. Can he still bring a lawsuit, having delayed seeking treatment for the injuries caused by the accident?

    The delay in seeking treatment does not prevent the driver from making a lawsuit, but it raises the possibility that the defense will argue that the injuries complained of occurred in a separate incident after the accident, and also that the injury is not serious enough to meet New York's threshold for bringing a personal injury case for a car accident. The motorist should consult a personal injury lawyer for an evaluation of his claim.
