    Default Divorcing When the Marital Home is in Your Spouse's Name

    A couple in divorce purchased a home, but titled it solely in the husband's name due to the wife's bad credit. He is employed, and she presently does not have a paying job. What will happen if they divorce? Will he be able to claim that the house is separate property, or will she be able to claim half of the home?

    Most likely, the wife will be able to have the house treated as community property. If she is concerned about the possibility of divorce and her rights after divorce, she should consult a family lawyer to discuss her situation in detail. Even if she does not presently plan to file for divorce, she should be able to get suggestions on how to protect herself in the event that a divorce eventually occurs.
