Caught with 8 Grams of Weed

My question involves police conduct in the State of, mainly involving the outcome of my encounter with the police: CALIFORNIA, county of Orange

hi, I was walking late at night on a tuesday (yesterday) in a mostly empty industrial parking lot (few parked cars) to get me a cookie ice cream sandwich. there is a desert place that closes at 1 am every day, which is why it was so deserted but there are a few businessmen who are still working, but at this hour eveything is mainly closed.

I met my cousin, he bought me chipotle and other stuff at target the other day and told him I would pay him back with weed. I gave him two joints, both with a gram each, and still had the other 5 grams for myself to consume at a later time. apparently there was a cop chilling and saw me hand my cousin the joints and he came to investigate. I had the other 5 joins (w a gram each) out so the cop saw it too. he took my id and i guess ran my name and asked me questions, which i stated i will not answer without a lawyer present.

he told me to get the hell out of here and go home and that next time he will take me in and book me in with drug charges, my question is since has my personal information should i be worried about getting a fine in the mail?

i do believe i was racially profiled because i am clearly hispanic but privilidged enough to live in a affulent mainly white area, my cousin and i are both in our early-20's just trying to enjoy cookies and ice cream

Did you read the bolded text I told you to? The [part where the cop SAW you with the joints. That's not profiling, that catching you flagrantly waving around a couple of joints. He didn't even have to try. You weren't trying to enjoy some cookies and ice cream, you were exchanging pot for other goods while having some cookies and ice cream.

I would say that you should count your lucky stars and have some more ice cream.

When an officer sees you publicly give somebody illegal drugs, there is a zero percent chance of convincing anybody that racial profiling is involved. When you commit a crime in the presence and line of sight of an officer, it is far from a surprise that the officer responds.

If he told you that you are not being charged, then you should consider yourself lucky.

You mean, you think if a white kid had done something as foolish as what you did, the officer would have charged them and hauled them off to jail?

He stopped to check if you were dealing hard drugs (which are also low grade misdemeanors rarely prosecuted now in CA). Marijuana ... Phht! The officer would not waste his time for something that is essentially legal, unless one or both of you were juveniles. Even then, a CRIMINAL prosecution is not likely even if you did manage to break the law.

Consider yourself fortunate, and keep your dope dealing indoors.
