    Unhappy What can I do to let my roommate leave

    I am currently live in NJ. I have been living in my current apartment (private house top floor) for more than 3 years. about 16 months ago i took over the entire apartment from my previous roommate. I don't have any lease with my landlord, but a joint bank account with my deposit in. I assume this is month-to-month rent.
    I let my current roommate moved in a year ago. She writes check to me rather than to landlord. We don't have any contract either since we thought we were friends. We did not have any problem till i asked her to move out a month ago. I just notify her orally. I am willing to give her more time till April (total 70days notice in advance)
    Now she said I cannot just let her go whenever I want. She said probably she won't be able to do move out before May.
    I want to ask: what do I have to do in order to legally let her out at least in April.

    If you are subletting to the roommate, then evict the person under your state's landlord tenant law.

    my question: since we don't have lease, how can I PROVE that I am subletting to her.

    Is there a notation on her check indicating the amount on the check is for rent?

    Last I checked, it's only 45 days until April.

    You will have to prove that in court.

    You will give the judges the facts: show she paid her rent; she stayed there; etc. etc.
