    If a resident of Mississippi passes away in an accident, and their family wants to bring a wrongful death claim, what is the statute of limitations?

    In Mississippi, the heirs step into the shoes of the deceased person, meaning that the statute of limitations is the same as that which would have applied had the deceased person survived. See common limitations periods, here. Note that although most wrongful death cases may have a three year limitations period, in some cases the statute of limitations may be considerably shorter. See Miss. Code Sec. 11-7-13.
