    Default When Can a Landlord Hold a Tenant Liable for Water Damages

    My question involves landlord-tenant law in the State of: California.

    Today I went to turn in my keys to my apartment. The landlord informed me that there is extensive damage under the sink and that it has rotted. The water had also seeped into one of the bottom drawers and it wouldn't open. This drawer had been damaged since I moved in, I had mentioned this to him and asked for it to be repaired although this was never done in the 5 months I lived in the unit.

    He said he would be bringing in a contractor to look into the damages to determine where they started from, but as of right now my deposit is being held and I also may be charged for the damages. When he walked into the unit and he showed me under the sink asking me if I had flooded it, I told him that it was clear there was a leak and pointed out the fact that it was wet directly under one of the pipes in the sink. No where else was it wet other than under the pipe.

    So my question is what should be my next step of action, and should I request to be present when the contractor comes in to do the inspection? I know that I was not responsible for this and it was clearly caused from a leak. I just received an email from the landlord stating all the damages with pictures and threatening small claims.
