    Default What to Do After a Class C Misdemeanor Arrest

    A man in Texas was in an argument with his wife and she called 911. He was arrested by the police for a Class C misdemeanor, even though the wife didn't want to press charges. What should he do?

    Odds are this is an assault charge under Sec. 22.01 of the Penal Code.

    He should speak with a criminal defense lawyer about the charge and possible dispositions. In Texas, he may be able to get a deferral of the Class C misdemeanor and, upon successful completion of a deferred sentence, expunge the record of the offense. That's most likely to occur if the man's record is otherwise clean.
