The first thing to do is to contact your spouse and ask.
If you cannot find your spouse, you can check the county court records in every county in which your spouse has lived since the time of your separation, to see if they have any record of divorce.
If you cannot find any records that you are divorced, and either can't find your spouse or your spouse won't respond, you should assume that you're not divorced and proceed by filing a divorce case of your own.
Although a spouse should be given notice of a divorce case, it is possible for a spouse to misrepresent to the court that notice was given or, when a spouse cannot be found, to get permission to provide notice by other means (e.g., publication, public postings, service on the last known address) that may not result in actual notice to the other spouse.
