    Default Can You Evict a Tenant Based on a Power of Attorney

    If you hold power of attorney for a landlord, can you file an eviction action on behalf of the landlord in order to evict a tenant, under Michigan law?

    If the power of attorney grants you the authority to commence eviction proceedings, then you can file the case. However, if the matter ends up going to hearing, you will still need a witness who can support the case -- and that witness will normally either be the landlord or the landlord's property manager.
