    Default What Constitutes Burglary in Florida

    In Florida, can you be charged with burglary for entering a property by bypassing a fence that surrounds the property, with a locked gate? Or is it necessary for a burglary charge for you to actually enter a building?

    Entering the land surrounding a building would be trespass, even if it involves climbing over a fence. Entering a home, structure or vehicle located on the property with the intent to commit a crime could result in a burglary charge (or similar charge).
