    Default Can a Salaried Employee Get Overtime Pay

    A salaried employee in Virginia is paid on a nominal 40 hour work week, but routinely has to work sixty to seventy hours per week. Can the employee be required to work that many hours without overtime pay?

    If the employee is properly classified as an exempt, salaried employee, then yes -- the employee can be required to work additional hours without additional pay or overtime pay.

    If the worker believes that he or she is improperly classified as exempt, the worker can try to obtain information or guidance from the state department of labor. Otherwise, the remedy is to ask for a raise or seek employment elsewhere.
