    Default Getting Probation Transferred to a Different State

    please explain to me how i may transfer my probation from state to state. i have addressed this with my p o and she doesnt seem to care. My parents both elderly are very ill and i had to change jobs and move back home to tend to their illnesses and financial matters. I no longer have the means to travel back and forth for probation visits. i have served my 48 hrs jail time for reckless driving and i want to do whats right by finishing all that is required of me. i was placed on unsupervised probation but i was told that i must report until all my fines are paid off. i no longer have a lawyer retained and im wondering if i can take care of this myself by going around my p o. I have informed her but she doesnt seem to care. please help me on this i really cant do any jail time for a violation for not going to my scheduled appointments with my probation officer.

    Default Transfer of Probation

    Typically, you work through your probation officer. If your request is approved, the probation office can make the arrangements with the destination state to continue your probation. If necessary you can probably bring a motion with the court which sentenced you, but I recommend obtaining assistance from a lawyer for bringing a motion, such that your motion is consistent with local law and practice, and you present the most compelling case to the judge.

    if i do get a probation violation will they extradite me from georgia to tennessee for a misdemeanor driving violation? (reckless driving)

    If you violate probation after a transfer, you would typically do your time locally, although if you needed to be resentenced as a violator that might necessitate your return back to the state where you were originally sentenced. Your probation officer can let you know specifically how your case would be handled.

    im having the same problem, with my probation officer he dont seem to really care about helping me getting my probation transfer, im trying to move from Minnesota to California, my parents are moving there and i would have no where to live here in minnesota, or any financial backing for i dont own a car or posses a job at the moment . i dont know what to do plz help me in any way to get my probation transfered!

    Warning, just make sure that your probation will be accepted by the state you want to move to. Our son was told that he could transfer to Florida, after 3 months of having him report, they decided not to accept his probation as prescribed by NJ. He had to move back to NJ to finish his probation. Our lawyer had checked it out prior to the move and we thought there would be no problems..so beware.

    It would be more correct to say, be prepared to live up to the terms of your probation in the new state. As you stated in your other thread, Florida accepted the transfer, but your son found their terms unnacceptable and refused to comply with them.

    I still don't quite understand how all of this works. NJ set the terms of his probation, knowing that he was going to move to Florida. Our lawyer assured us that he would be "monitored" by Florida under the terms agreed by us and NJ. Florida doesn't understand the statute under which he was sentenced, which is not a meagan's law statute. Why should he have to be "resentenced" in Florida when the events all occured out of state? Why would anyone willingly sign up as a sex offender, when you fought like hell not to have that stigma attached to your name? When all of the transcripts were sent down and shown that that wasn't the case? Just need clarificaton of this. Our lawyer is still in shock that this happend.

    I thought that this fit into what was being discussed. I was responding to a comment made on this thread. Next time I'll do what you suggest.
