My question involves a consumer law issue in the State of: NJ

I listed expensive ($1000) women shoes on Craigslist and sold it, shipping it from NJ to NJ, after the buyer paid through Paypal.
After receiving the shoes, the buyer, by email, claimed they have a defect and demanded more discount and also stated if no discount, he "have to return the shoes" (stated in the email).

I refused further discount, since original amount was already discounted.

He started a claim with Paypal and Paypal fully refunded him.
It's been about 53 days, and the last email I sent to him was on Dec 26, 2016. He does not respond. I'm asking to return the shoes in original condition, - asking in my emails.

He lives withing 45 minutes driving from me, but we live in different towns, zip codes and counties.

I never had a situation like this, but I'm thinking about filing in small claim court against him.

He is a lawyer, licensed in NJ and NY from 2008, specializing in Personal Injury Claims.

As such, I think my time in court will be not easy, trying to win this case, - and I want to know upfront what he can use at his defense. Hence, - posting in Consumer Law section.

Where do I have to file the case - in his town or in mine? Is it absolutely required to have an attorney with me? If he does not respond, can I write to his law firm work address, or can I stop by at his work to talk to him about this case, since I'm not comfortable calling him and he hangs up the phone? How much time I have before filing in court?

I have emails, with photos attachment for the item and Paypal transactions (original payment and the refund transactions), as my proof.
Let me know, please, what might be helpful for me.
