    Default F1 student charged with shoplifting

    I am a student with f1 visa in Oregon. I was really depressed recently and wondered to another nearby city on Sunday. I was carrying $400 DVDs walking out of Costco when the store security stopped me at the door. I didn't know why I did it, but I felt really numb for what happened before the police was called. I had no any other previous record, so the policy did not arrest me but gave me a citation. I am working with a lawyer who said he dealt with a similar case before that resulted in a dismissal. I guess this is my best chance. Right now, I am seeing a therapist to deal with my depression. And my lawyer told me that he will contact with Costco and try to get them drop the charge. But he can not promise anything. The lawyer and I went to the court, get an option for plea guilty of misdemeanor with fine and court fee. I don't remember if there is a community service or pending jail sentence. My lawyer said there is also chance for reduce to plea guilty for violation.

    My question is if I get dismissal, how this will affect me if I leave and apply for a new f1 visa. and what will happen when I re-enter US at the airport. Will I be rejected for the visa or the entry? I am graduating in a year. How would this affect my future job in the US and h1 visa? Is there anything that I can do? or just wait until my lawyer tells me what to do? If Costco doesn't drop the charge, what's the next best option for me considering my status? What will happen to me when I re-enter the country, apply for GC or even CZ?

    I cannot even sleep after what has happened, and feel even depressed more.

    A dismissal with no allocution (where you admit to facts constituting the offense on the record) is the best outcome. You may still have to report the encounter with the police on various immigration forms, or be asked about it at hearings, but you would not have a conviction.

    Thank you, Mr. Knowitall. What if the charge is not dropped? What is the best option that my lawyer and I should fight for? Even if the charge is dropped, do I need to hire a immigration lawyer to deal with whatever issue that may come up when I change the status?

    The charge is dropped. However, my lawyer told me that I still need to have the arrest record expunged. How do I get the record expunged? Do I need to have my lawyer to do it? I am short on money, I hope there is a cheap way.

    My question is that I need to go to Canada soon for a family get-together. I am afraid that I will be denied for the visa to Canada, or stopped for questions at the custom (at the entry to Canada and US), or be denied for entry to Canada or US. Does any one know what I can do? Any suggestion?

    I will also be in job market soon. How does this record affect my job searching?

    Please help!!!

    Job application usually require you document your convictions! Since you have no conviction you should be fine.

    Please give me the contact info of a good lawyer for a shoplifting case at Costco. I am being held for shoplifting.

    Was your lawyer able to have Costco drop charges. Can you provide me the name and contact information of the lawyer in Oregon.

    I'm also under great stress and falling off the cliff. Just like you I'm also on F-1 visa and I think you know how the situation is.
