    Default What Happens if a Protected Person Initated Contact with Restrained Person

    My question involves criminal law for the state of: California

    I have initated contact with the restrained person after first a civil restraining order was issued ... and then after she received a criminal restraining order ...

    I do not want to see her being arrested for something that I have initiated. The restraining order was granted based on my wife's complaint about harassing mail.

    I was not originally on the petition but the judge asked if I wanted to be in it since my wife had also listed our children in the order ... I want ahead with it since my wife would not have received if I was in a relationship with the woman

    But I still continued contact which lead to her arrested when she confronted my wife ... I would have never called the police to have her arrested ...

    But now that I have continued contact with her ... can my wife report the violation of the order? My wife has repeative has said she would have her arestted ...

    Does my wife have that ability even though she is not in contact with her directly?

    ... then of course the other question is how do I get myself removed from the protective order?

    You mention a relationship with the person who is prohibited from contacting you and your family. I’m going to guess that it is a romantic relationship (and thus one of the reasons why your wife is ticked off about it). Those kinds of situations almost always lead to all kinds of drama, and you drag the police and courts into it, there is a chance of someone ending up in jail. Here if you you or your wife end up having contact with that other woman, that other woman can indeed end up facing a charge of violating the order and perhaps going to jail. If you want to get removed from being a protected person under the order, see an attorney about filing the appropriate motion in court to do that.

    You will want to think about what really most matters to you: your relationship with your wife or your relationship with this other woman and then take steps to be with one or the other, but trying to maintain a relationship with both may well end up ruining it all the way around for you.

    So let's get this straight - you had an affair. The other woman started to harass your wife. Your wife got a protection order - and you are also listed on their along with the petitioner?

    Do you love your wife? Do you want to stay with your wife and kids? If so then stay the **** away from the girlfriend. Yes your wife can get that woman arrested even though you contacted her first. You are setting that other woman up for failure every time YOU contact her.

    YOU are on the form as a protected person then that means every time that woman answers you or sees you she is violating the order. How do you not get that? If you want to be with this woman you need to leave your wife. You're being selfish.
