A homeowner in California owns a business and had a relative stay in his home while the relative worked for the business. The relative did not pay rent, and lived in a converted garage that is part of the home, but functions as an independent apartment -- it has a kitchenette and bathroom. When the homeowner and the relative went out of town to work on a job, the business owner's family heard noise in the relative's room and investigated. They discovered that he had allowed his sister to move in.
When she refused to leave, they filed an eviction action against her. She has countersued, claiming that she is entitled to relocation assistance because the garage space was improperly converted without a permit, and is not a legal rental unit. Can she succeed in getting relocation assistance?
