    Default Can a Landlord Make You Give Up a Dog Based on Breed Restrictions

    A tenant wants to adopt a dog, and the landlord agrees that the dog can move into the unit, but with the caveat that the dog must not fall within the breed restrictions of the landlord's insurance company. The dog is mixed breed. If the insurance company decides that the dog looks like one of the restricted breeds, can they make the tenant get rid of the dog or move?

    If the dog looks enough like a restricted breed that this may be an issue, the tenant is likely best served by choosing a different dog. In the alternative, there are presently companies that offer cheek swab DNA testing to determine dog breed, so they have the option of testing the dog and getting documentation of its actual breed(s), and seeing if the insurance company will approve the dog based on the test result.
