    Default Can a Former Tenant Claim Squatter's Rights

    Tenants in Florida moved out of a rented room in a home when they broke up. The boyfriend is homeless and is facing criminal charges. As he has nowhere else to go, he has told the landlord that he is moving back into the rented room based upon "squatters rights". Does he have any legal right to move back in?

    First, by even the loosest definition, to be a "squatter" you must be in actual possession of land -- you can't be a "squatter" if you've already vacated.

    Second, no, there is no sense of "squatter's rights" that would allow a former tenant to move back in. The concept of squatter's rights comes from the legal doctrine of adverse possession, which is not implicated by tenancy and also requires continuous possession.
