    Default Can a HOA Restrict Residents to Flying the American Flag

    If a HOA in California allows tenants to fly flags, can it impose a rule that the only permitted flag is an American flag? Doesn't that rule infringe upon homeowner's rights?

    Although homeowner's associations have broad rights to limit signs, flags, and other displays on homeowners' property, that right is not without limit. They can't, for example, say that you can post political signs in your yard but only for one political candidate or party.

    The flag issue strikes me as similar. A HOA could provide in the CC&Rs that no flags are permitted, but once it allows flags it has a limited ability to constrain the speech rights of homeowners who want to fly other flags on their own property.
