    Default Expuction For Possession of Drug Paraphernalia

    I am 17 years old and was recently issued a citation for possession of drug paraphernalia. This is my first time ever being in trouble with the law and the reason I received the citation is basically because I was in the wrong place(a friend's car. It was her pipe) at the wrong time. After doing alot of research on the internet I am pretty sure that this is a Class C Misdemeanor and I will most likely receive deferred adjudication. Am I correct in assuming this? Also, is deferred adjudication enough to keep this off my record or should I also be prepared to try and receive an expungement? I am most concerend about colleges and scholarship officials finding out about this.

    Look into drug diversion, which is probably a superior option to a deferment. If you avoid a conviction it shouldn't affect your financial aid, but I don't know enough facts to guess as to what's going to happen.

    Yes, this was most likely a Class C Misdemeanor. If you take deferred adjudication, it will most likely appear on your record and you will have to disclose it when you apply to schools or on employment applications. Deferred adjudications for Class C Misdemeanors can be expunged which means you can deny the charges on such applications. If it is anything other than a Class C, you cannot expunge it but rather seal it. However, schools can still get access to sealed records which means you may still have to disclose it. Most employers though cannot get such access and you are still permitted to deny any arrest or charge relating to the offense.
