    Can you sue a child's school if she is assaulted by another student on the playground during the school day, under Virginia law?

    The mere fact that an assault occurred, by one student against another, is not going to be sufficient to establish liability. Schools cannot prevent all playground fighting, bullying and other inappropriate behavior, even though some of it may be injurious.

    If the injury is serious, or more facts are involved that could create liability on the part of the school or its employees, the parent should consult a personal injury lawyer for a review of the case based upon the full facts.
