    Default Does an Employer Have to Follow Consistent Hiring Practices

    An employer posted a job, and most of the candidates went through a consistent process, from application, through interviews, through a decision on their application. The person who was hired was selected by the company president, and the managers who had conducted the interview process were told to hire that person even though he did not go through any of the process that the other candidates had to go through. That's not fair, but is it unlawful?

    It is not unlawful, even though it is unfair. Employers can make arbitrary hiring decisions, and can hire friends of executives even when they're less qualified than other candidates or are permitted to bypass the standard hiring process.
