    Default How Can a Landlord Collect Unpaid Pest Control Fees

    A landlord in Ohio has a lease that provides that the tenant of a single family home he rents out must pay for pest control and extermination services. The lease provides that if the landlord performs pest control, the landlord can recoup the cost from the tenant. The tenant requested pest control and said that she could not afford the fee, so the landlord provided the service and then billed her. She says that she does not have the money to pay the bill. How can the landlord recover the money?

    If the lease does not make the reimbursement a form of rent, then the landlord may bill the tenant and, if the tenant is unable to pay, deduct the fee from the tenant's security deposit at the end of the tenancy. If the tenant is month-to-month, the landlord may give notice to quit. If the tenant has a lease term, unless the cost of services is quite substantial, I doubt that a court would find nonpayment to be a material breach of the lease so as to allow for an early termination for cause -- a local lawyer should be able to advise about what the local courts might be inclined to do.

    If the amount billed is characterized as rent, I suggest having a lawyer review the lease to make sure that the provision is legal and enforceable and, if so and the amount owed warrants the action, give notice for nonpayment of rent and, if necessary, proceed with an eviction action.
