    Default Is a Landlord Responsible for Damage Caused by a Repairman

    A landlord in California had a repairman replace a heating unit in a rental property. The repairman's apprentice didn't use proper floor protections, and got soot onto the tenant's area rug. The repair service tried to clean the carpet at the time, but ended up making the problem even worse and caused further damage. The tenant wants the carpet to be be replaced. The landlord says that it's the repair company's responsibility. Who has to pay to replace the rug? The tenant has renters insurance.

    Depending on the value of the rug, the tenant may opt to make a claim through the renter's insurance, and then try to recover the deductible in small claims court.

    It may be possible to make a case against the landlord as the principal of the repair service, the landlord's agent, but that's an assessment best made by a lawyer who has fully reviewed the facts. The repair service appears to have been negligent both in damaging the carpet and in its cleaning effort, and it would seem difficult for that service to avoid liability.
