    Default Fortune 500 Employer is Not Paying a Promised Bonus

    My question involves labor and employment law for the state of: California

    Hi,

    I work for a fortune 500 company in California and my company wanted to me relocate (short term) to a different country for a period of 6 months and as part of the relocation the company had promised to pay me a one time bonus of 40000$ just to cover my US expense while I was away as my salary at the new location was less. I was promised that this bonus will be paid to me once I am back in US.

    After completing the 6 months period when I returned back to USA and asked for my promised bonus, my manager initially said that the HR is still processing the request and now after two months, my manager says that the company does not have funds to honor this request. At this point I have not threatened any legal action and still trying to convince my manager that ethically and legally this is not right.

    At this point, I have couple of emails and chats with my manager where he has mentioned in writing that the company will pay a one time bonus to me as part of the short term transfer. I want to know if there is any other documents that I should try to get my hands on to build a stronger case if I decide to take this legally.

    Would really appreciate if any one can provide some guidance on what are my options here.

    I can't imagine what other "documents" you expect to get since your "promises" were oral other than what you already have.

    I suggest you consult an attorney and have your emails and chats evaluated to determine whether you have enough of a contract to warrant a lawsuit.

    A Fortune 500 company that can't afford a $40K bonus payout? Have they said they will not ever pay it or are they maybe waiting for the new quarter to pay it out?

    I think oral conversations can be considered as contract as well. Can text chats/conversations be considered as documents?

    There is a large difference between a manager orally mentioning a large bonus and HR/TPTB approving it. Did you get nothing in writing BEFORE you took the assignment? Did the manager copy anyone else on the original email about the promised bonus? Does he have the authority to grant bonuses and make pay decisions 100% by himself?

    Who is telling you there is no money to pay it? The Manager?

    I'd go above the manager's head to HR and ask them if they have any knowledge and let them know what was said in all conversations. But in the end, it might be a "you said/he said" situation and if the bonus was never approved, then you could argue he was acting on the company's behalf, but I doubt that will fly since you got not official documentation.
