    Default Can You Avoid Eviction if You Pay the Judgment After an Order of Possession

    A landlord in Indiana took a tenant to court for nonpayment of rent and was issued an order of possession. The tenant has paid the money judgment. The tenant wants to know if the order of possession is still valid, such that the landlord may proceed with an eviction.

    Under those facts the order of possession remains valid. If the landlord does not agree to allow the tenant to remain and resume paying rent as a tenant, and the tenant does not vacate, the landlord can proceed with an eviction.
