    Default Can an Illegal Immigrant Re-Enter the U.S. After Traveling Abroad

    A person who entered the U.S and overstayed was married to a U.S. Citizen and, at the time began the process of obtaining citizenship through. The marriage failed while the person's Greed Card was still conditional, the person's permanent residency was revoked, and their appeal was denied. They have since married a permanent resident, who is years away from qualifying for citizenship. The person wants to travel with her husband to Europe. If she leaves the U.S. for that trip, will she be allowed to re-enter?

    On those facts? No, she will not be allowed to re-enter, and her overstay is almost certainly long enough to trigger a lengthy period of ineligibility to reenter.

    Realistically speaking, if she leaves the U.S. she should expect to be outside of the U.S. indefinitely. She should discuss her travel plans and immigration options with an immigration lawyer.
