    Default Claiming Child Support from Wrongful Death Proceeds

    A man in New York passed away while owing his ex-wife a significant amount of child support. The man's family is pursuing a wrongful death action from the circumstances surrounding his death. Can the ex-wife recover his child support arrears from the wrongful death recovery?

    The woman should make sure that she makes a timely claim for the child support arrears as a creditor of the estate. The estate debts, including child support, should be paid from the estate's assets before the balance of the assets are distributed to the heirs.
