    Default Do You Have to Repay Relocation Costs Paid by Your Employer if You Resign

    My question involves labor and employment law for the state of: NJ. I transferred location within my company that provided a great relocation package. Part of that was covering up to 50K for loss on sale of my former residence in the old location. My employer had me sign a document stating that if I voluntarily leave within 3 years I would have to repay the loss on sale payment. If I am terminated I do not have to repay. At this point, I would have to repay 33% of that amount. However, the agreement takes place over 3 years and is more than 10K.....it was never signed by my employer/I never received a signed copy. Also I requested this document from my employer and they sent me an unsigned copy. If it is a valid agreement? If so, how can I get out of it. In NJ is job abandonment considered resigning? Any creative ways to get terminated? Thanks in advance for all of your comments!!!

    Did you receive and accept the terms of the relocation agreement before you accepted the benefits of that relocation assistance?

    Did you sign the agreement?

    If you signed an enforceable agreement to repay location costs if you resign, you do.

    If you signed an unenforceable agreement to repay location costs if you resign, or alternately if you did not sign anything agreeing to repay location costs if you resign, then you don't.

    It really is that simple.

    If you signed something and you don't know if it is enforceable or not, show it to an attorney in your state. We can't read it from here.

    And yes, job abandonment = voluntary termination.
