    Default Can a Tenant Make a Claim Against the Owner's Insurance

    If there is a fire in a condo unit, and the tenant in that unit does not have renters insurance, can the tenant file a claim with the condo owner / landlord's insurance company for the property she lost in the fire? This is in Florida.

    Can she submit a claim? Yes, if she has the necessary information to do so. Will she recover for her losses? Probably not, as the policy likely excludes a tenant's personal property, but we can't know the terms of coverage without reading the insurance policy.

    If the fire was caused by the negligence of somebody other than the tenant, and the person or entity responsible for causing the fire is insured, the tenant may seek recovery through their insurance coverage, or may consider suing them.
