    Default Overtime Discrimination for Exempt Employees

    An employee of a company in Michigan is an exempt, salaried employee. However, he and another co-worker, both of whom have the same Asian heritage as the business owner, are required to work longer hours than other employees in the business. They have the same job title and job description, but are often expected to work three or four hours beyond everybody else's quitting time. Is that unlawful discrimination?

    It may be unlawful discrimination. It may also be based upon the employer's business needs -- the need to have employees present who speak his native language, or who can speak with customers or vendors who speak their language. The employee should consult a plaintiff-side employment lawyer with the full facts, for a review of the situation and advice as to what he can do. The consultation should be free.
