    Default Employee Was Not Paid an Earned Bonus After Being Laid Off

    A California employee was laid off, and received a final paycheck. The paycheck included the employee's bonus for his final, partial month of employment. However, bonuses are usually calculated and paid in the month after they are earned, and he is still owed his bonus for the prior month. The employer is not responding to the employee's inquiries. How can he get his bonus?

    He can file a wage complaint with the Labor Commissioner's Office. In addition to the overdue bonus, the employee may be eligible to receive waiting time compensation -- one full day of wages for each day, after termination, that the employer fails to pay the employee's wages, up to a maximum of thirty days.
