    The penalties for a marijuana DUI are the same as for a DUI that results from alcohol intoxication. For a first offense, the penalty is typically twenty-four hours in jail, fines in the vicinity of $1,000, drug or alcohol treatment, a driver's license suspension, up to five years of probation, and possibly additional costs and assessments.

    It may be possible for the defendant to qualify for a diversion program so as to avoid a criminal conviction, and to receive lesser penalties than might otherwise result. A local lawyer can advise the driver, based upon the full facts, what is likely to happen in court.
