Under $500 - Class B Misdemeanor - Jail up to 6 months and/or fines up to $1000.
It's an arrest in the sense that you were apprehended and charged, even though you weren't hauled off in handcuffs.
The case, and its resolution, will definitely stay on your CRIMINAL record. Even a diversion, dismissal and expungement will never completely disappear thanks to the internet and the whole world being connected in computers.
Diversion may be possible. That's up to the authorities.
Right now, though, you need a criminal defense attorney. He will know how to get you out from under this (if possible), you won't.
Be prepared to shell out several thousands of dollars for the civil demand from the store, lawyer fees, and fines as the cost of that $299 item.
