    Default Owner Liability for an Accident in a Borrowed Car

    A California resident let her elderly father borrow her car. He hit and badly injured a pedestrian. Her father has since passed away. If his estate isn't sufficient to cover the injury claim, how much can the driver collect from her as the owner of the car?

    In general, her liability for an accident caused by a permissive user would be capped at the state insurance minimum ($15,000 / $30,000). That could change if her father were deemed a high-risk driver, in which case a negligence claim could be pursued against her for any amount of damages not covered by her father's insurance or estate. Ideally, she will have sufficient liability coverage to address any claim that is brought against her based upon ownership or negligent entrustment.
