    Default Changing My Child's Last Name to My Husbands Last Name

    My question involves name change laws in the State of: California,
    My child has my seconds sons dads last name because he was who i was with when i was pregnant. so he is not the father, his Biological father has only seen him a handful of times and he is now 5 and its been over 3 years since hes seen him. He has no interest in him never has the few times he seen him was to stop me from putting him on child support. I have been married for 3 years and my husband has been around since my son was 2 he is the only father he knows. What can i do ?

    You can file to change your son's name AND serve the child's father so that he can show up and dispute the name change. Expect that trying to accomplish a backdoor adoption in this way most likely will not work. Why haven't you filed to establish paternity, child support, and visitation?

    i have filed and he has been served back in 2012, i just have not turned in the proof of service. Can i still turn it in and go from their or just file for step parent adoption. He hasn't looked for my son in any way. ive tried over and over and he says he will look for him see him etc but never does so i feel like i shouldn't beg someone to be in my sons life if he doesn't want to . what do you recommend?

    You need to start over. YOU cannot have served him a complaint. You are a party. YOu really have no clue and need legal counsel. The fact that apparently you have two children in the exact same situation doesn't speak highly of you.
