    Default Violation of Tenant Rights in Seattle

    I have not had any peace and quiet since I moved into my apartment 11 months ago. The first problem I encountered was the ventilation system, which is located underneath the windows of my apartment. Anytime someone comes in or out of the garage, the ventilation system comes on, and its like listening to an airplane engine for 3 to 4 minutes, sometimes longers. Usually people start leaving to go to work at 4 a.m. and it continuous on throughout the day. After numerous complaints the landlords of this building had it inspected about 5 months ago, and it was found that it did not meet city code. It was too loud. To fix it they would have to pay $10,000.

    The building was told that the noise level had to be reduced by 10 to 15 decibels to meet the standards. They were not fined because when they opened the building for tenancy the building inspector signed off that there wasn't any problem with it. Now they know it has to be fixed.

    Starting January 2007, the lower level of where I live was rented out for commercial use. Since then all I hear is hammering and drilling and screeching all day long. The construction crew is there from 0730 am and are there until 5:00 pm. I work at night, so I can't get any sleep at all. I am starting to get physically ill from all of this.

    Today, I went to inform them that I would be moving out by the end of February. My lease expires 2 April 2007. I was told by management that if I did not pay the last months rent, that they would take me to court. That they have the muscle and the top notch lawyers to drown me in paperwork. That this was something they didn't want to do, but they would.

    I believe that my civil rights have been violated repeatedly. The peace and quiet enjoyment of my home has never existed since I moved in. I was told by them that if the clause is not in the lease then I don't have a leg to stand on. Isn't it a convenant that's implied in all rental agreements. I will go over the lease with a find tooth comb, and find out whether or not it's in the contract. I don't think it is. Please advise.

    At the end of Feb give a 30 day notice that your leaving when lease expires!
